DUI Frequently Asked Questions
Typically you will be asked to submit to three separate field sobriety tests:
Horizontal Gaze Nystagmus (HGN) Test - this test is administered to determine if your eyes experience nystagmus or jerking when you are attempting to track an object from side-to-side with your eyes.
One Leg Stand Test - a divided attention test requiring you to stand with one foot six inches off the ground pointed forward while counting to thirty. You are expected to maintain perfect balance without using your arms to aid you.
Walk and Turn Test - another divided attention test requiring you not only to listen to the instructions and perform the test exactly as instructed, but also walk in a straight line taking nine steps in a heel-to-toe fashion.
Your license will be suspended for 6 months. However, you are entitled to appeal the suspension and receive a Temporary Alcohol Restricted License if you request an administrative hearing within 30 days of the arrest. If you fail to request the hearing within 30 days you may still be able to obtain a Route Restricted Driver’s License if it is your first offense and you have enrolled in ADSAP.
